Terms of Service

1. Acceptance of Terms

By accessing or using the TownWebsite platform and services at townwebsite.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

TownWebsite provides modular, managed website solutions for municipal governments. Our Service includes website hosting, content management, and related tools for towns and municipalities.

3. Eligibility

The Service is intended for use by municipal governments, their authorized representatives, and visitors to municipal websites hosted on our platform. You must be at least 18 years old to enter into a service agreement with TownWebsite.

4. Accounts and Access

  • Municipal customers are responsible for maintaining the security of their admin credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

5. Subscription and Payment

  • Services are billed on a monthly basis at the rate agreed upon at signup.
  • There are no multi-year contracts. You may cancel at any time.
  • Cancellation takes effect at the end of the current billing period.
  • We reserve the right to adjust pricing with 30 days written notice.

6. Customer Content

Municipal customers retain full ownership of all content uploaded to their websites. TownWebsite does not claim ownership of customer content. By using the Service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with the proper functioning of the Service
  • Use the Service to send unsolicited communications (spam)

8. Service Availability

We strive to maintain 24/7 uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our control.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Municipal customers are responsible for compliance with applicable privacy laws regarding their residents' data.

10. Data Portability

Upon cancellation of your service, we will provide a reasonable period (minimum 30 days) to export your content. After this period, data may be permanently deleted from our systems.

11. Intellectual Property

The TownWebsite platform, including its design, code, and branding, is the property of TownWebsite. Customer content remains the property of the customer. Template designs provided by TownWebsite are licensed for use during your active subscription.

12. Limitation of Liability

To the maximum extent permitted by law, TownWebsite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold TownWebsite harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate access to the Service if you violate these Terms. You may cancel your subscription at any time through your account or by contacting us. Upon termination, your right to use the Service ceases immediately.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Maine, United States, without regard to conflict of law provisions.
